Then, you should write down as much information about the accident as you can, including the names and phone numbers of the other driver and passengers involved, and any witnesses to the accident. Note all parties' injuries and vehicular damage. Take down the insurance information and driver's license number of the other driver. If a police officer responded to the accident, be sure to get his or her information. Who Is Responsible for My Injuries?
Motorists have a duty of care to exercise reasonable care while driving. If a driver breaches this duty and fails to exercise due care, and/or exhibits driving behavior that is reckless or otherwise dangerous, and causes an accident, he or she is at-fault for the accident and was negligent and thereby legally responsible for any damages incurred.

Colorado law allows injured victims to pursue compensation even if they were partially at-fault for an accident. This is called "comparative fault." Colorado is a "partial" comparative fault state. According to the doctrine of comparative negligence, the plaintiff may collect damages proportionate to the defendant's percentage of fault for the accident, up to 50 percent of their own fault. For example, if the defendant was 70 percent at fault, the plaintiff is eligible to collect 70 percent of his or her total accident-related losses and expenses. However, once the injured party is found 50 percent negligent (or more), they no longer have a right to damages.
