What Is Long-term Disability Insurance?

Disability insurance replaces your income if you become disabled and are unable to work. In the event that you injure yourself or develop an illness that prevents you from working, short-term disability insurance benefits are initially provided to you, generally for a period of three to six months. If you are still unable to work after your short-term disability benefits expire, and you have a long-term disability insurance policy, those benefits will kick in at that time.

Long-term disability benefits are typically available through your employer, but may also be purchased privately. Depending on your particular policy, long-term disability benefits will replace a percentage of your regular income not exceeding a certain amount (for example, it may cover 60 percent of your income, up to a monthly maximum of $10,000).

J. Todd Tenge and the Tenge Law Firm has the experience, expertise, and resources necessary to help you file a successful long-term disability claim and obtain the benefits to which you are entitled. Our legal team can also fight on your behalf against insurance companies who unfairly deny, ignore, delay, or underpay claims. "Own Occupation" and "Any Occupation" Eligibility

"Disability" is defined two ways. You may suffer a disability that prevents you from performing the duties of your "own occupation" - meaning your regular job. If you are unable to perform the duties of your own occupation for a specified period of time, you may apply for "own occupation" benefits, which are usually provided for two years.

After a certain amount of time, you will be evaluated again, this time to determine whether you can perform the duties of "any occupation." Under this particular definition, you will need to prove that you are unable to perform the duties of your former job and any other job for which you are capable or qualified, based on your work history and experience, education, and ability to retrain. If you are determined to be disabled under the "any occupation" definition, you will receive benefits for an extended period of time - anywhere from several years to when you reach 65 years of age.
